1. Introduction

InQ Tax Inc. ("InQ," "we," "us," or "our") is a Missouri corporation that develops and operates software solutions for tax and accounting professionals.

We recognize the importance of protecting personal, financial, and taxpayer information entrusted to our systems. This Privacy Policy explains how we collect, use, store, protect, disclose, and otherwise process information in connection with our websites, software products, and related services.

This Privacy Policy applies to:

  • Visitors to inqtax.com and associated websites or subdomains.
  • Tax and accounting firms subscribing to InQ software.
  • Employees and other authorized users of subscribing firms.
  • Taxpayers and other clients accessing InQ through their tax or accounting professionals.
  • Individuals communicating with InQ for sales, marketing, technical support, or other business purposes.

Our software products include InQ Check-In, InQ Portal, InQ Notices, and other products or services that we may introduce.

These products and their related functionality are collectively referred to as the "Services."

This Privacy Policy should be read together with our Terms of Service and any applicable agreements governing your use of the Services.

2. Our Role in Handling Personal Information

InQ provides technology that tax and accounting professionals use to manage their businesses and communicate with their clients.

The responsibilities for personal information depend on the circumstances under which that information is collected or processed.

2.1 Information Processed on Behalf of Tax Firms

When a subscribing tax or accounting firm uses InQ to collect, store, transmit, or manage its clients' information, the firm generally determines why the information is collected and how it will be used.

In these circumstances, the firm generally acts as the business or data controller, and InQ acts as its service provider or data processor, as those terms may be defined under applicable privacy laws.

InQ processes this information to provide the Services, follow authorized instructions, maintain system security, fulfill applicable legal obligations, and perform other activities permitted by law and applicable agreements.

2.2 Information Collected Directly by InQ

InQ may act independently as a business or data controller when collecting information for its own legitimate business purposes.

Examples include:

  • Establishing subscriber accounts.
  • Processing subscription purchases.
  • Responding to support inquiries.
  • Communicating with prospective customers.
  • Administering marketing campaigns.
  • Maintaining website security.
  • Analyzing business and website performance using operational information rather than third-party advertising trackers.

2.3 Relationship with Client Users

Individuals who access InQ through their tax or accounting firm should understand that their firm generally controls their client records and determines their permitted access to those records.

Requests involving documents, tax information, professional engagements, or client records should ordinarily be directed to the applicable tax or accounting firm.

InQ may assist those firms in fulfilling appropriate requests, subject to applicable law and contractual obligations.

6.1 InQ Check-In

Check-In may process information concerning client visits, intake activity, return status, assigned personnel, office locations, and administrative workflows.

The information may be used to organize a firm's work, communicate with clients, and produce operational reports.

InQ does not independently provide tax representation or resolve tax notices on behalf of subscribers.

6.4 Future Products

InQ may introduce additional software products or capabilities.

New products that operate within the scope of this Privacy Policy will be covered by it unless separate privacy disclosures are provided.

If a new product materially changes the categories of information collected, the purposes for processing, or the circumstances under which information is disclosed, we will update this Privacy Policy and provide any notices or obtain any consents required by applicable law.

7. Taxpayer Confidentiality and Section 7216

InQ recognizes the confidentiality obligations applicable to information obtained in connection with preparing tax returns.

Internal Revenue Code Section 7216 and its regulations may restrict certain disclosures and uses of taxpayer information by persons engaged in tax return preparation or activities connected with tax return preparation.

InQ's Services are generally intended to support ordinary tax and accounting firm operations, and many processing activities may be permissible without separate taxpayer consent.

However, whether consent is required depends on the particular information, activity, circumstances, and applicable legal requirements.

Subscribing firms are responsible for:

  • Evaluating their obligations under Section 7216 and other applicable laws.
  • Determining whether taxpayer consent is required for a particular disclosure or use.
  • Obtaining legally sufficient consent when required.
  • Maintaining appropriate documentation of such consent.
  • Configuring and using the Services in accordance with applicable confidentiality requirements.

InQ will process taxpayer information for authorized purposes consistent with applicable law and recognizes that certain tax confidentiality obligations may also apply directly to InQ.

InQ's domestic operations and hosting arrangements do not eliminate legal consent requirements that otherwise apply.

Nothing in this Privacy Policy authorizes a disclosure or use of tax return information prohibited by applicable law.

8. U.S. Operations and Data Hosting

InQ Tax Inc. is a United States-based company.

Our primary application infrastructure and servers are located within the United States.

We intend to maintain domestic hosting for taxpayer and client information stored within our hosted application systems.

Certain third-party providers, including Stripe, BoldSign, and other supporting services, may operate their own infrastructure or process information in additional locations.

Where these services are used, information may be processed according to the applicable provider's operations and contractual arrangements.

InQ will evaluate such arrangements against applicable privacy, confidentiality, and tax information requirements.

We do not represent that every third-party transaction, communication, or technical service remains entirely within the United States unless that representation has been specifically verified.

9.7 Business Transfers

If InQ participates in a merger, acquisition, restructuring, financing transaction, or sale of business assets, information may be transferred as part of that transaction where permitted by applicable law and contractual obligations.

Any receiving entity will be subject to applicable requirements concerning confidentiality and the continued handling of personal information.

9.8 With Authorization

We may disclose information for additional purposes when the person or entity authorized to provide consent has lawfully authorized the particular disclosure.

10. Third-Party Integrations and Services

InQ currently uses third-party integrations for certain operational functions, including Stripe for payment processing and BoldSign for Form 8879 knowledge-based authentication.

Additional third-party infrastructure, hosting, email delivery, and supporting services may be used to operate the platform.

When a subscriber enables or uses an integration, InQ may transmit or receive information necessary to provide the selected functionality.

Such transfers depend on the integration's features, the information involved, and the permissions granted.

Third-party providers may have their own privacy policies and data processing requirements.

Subscribers should review those policies before using features involving sensitive information.

InQ does not control the independent privacy practices of third-party providers.

InQ does not currently use Google Analytics, Meta Pixel, third-party advertising cookies, retargeting pixels, or similar marketing tracking technologies.

We do not use website visitor activity to build advertising profiles or create retargeting audiences.

Users may configure their browsers to block or delete cookies. However, disabling essential session cookies may prevent users from logging in or using certain features of the Services.

If InQ introduces nonessential analytics or advertising cookies in the future, we will update this Privacy Policy and implement any notices, choices, or consent mechanisms required by applicable law.

12. Marketing Communications

We may send promotional communications to individuals who have contacted InQ, requested information, subscribed to our communications, or otherwise have a legally permissible business relationship with us.

Promotional messages may include product announcements, feature information, educational content, and special offers.

  • Important product or account changes.
  • Contractual and legal notices.

Communications initiated by subscribing firms through InQ are generally controlled by those firms.

Information deleted from active systems may remain temporarily in backup or archived systems until it is removed through applicable retention and recovery procedures.

Information subject to legal holds or mandatory retention obligations may be preserved for longer periods.

15.6 Account Cancellation

Cancellation of a Subscription does not necessarily result in the immediate deletion of all associated information.

Access, retention, export, and deletion following cancellation are governed by applicable agreements, system capabilities, and legal requirements.

InQ will not retain personal information longer than reasonably necessary for the applicable purposes, subject to legal and contractual requirements.

16. Your Privacy Rights and Choices
